These Terms & Conditions govern your use of TechDiagnose (the “Service”). The Service is provided by TechDiagnose (“we”, “us”), and by using it you are entering into an agreement with TechDiagnose. You can reach us at support@techdiagnose.app.
1. Acceptance
By creating an account or continuing to use the Service you agree to these terms. If you are using TechDiagnose on behalf of a company, you confirm you have authority to bind that company. If you are using it as an individual, you confirm you are of legal age.
2. What the Service does
TechDiagnose is an AI-assisted troubleshooting tool for HVAC and related equipment. You describe symptoms, answer guided questions, and optionally upload photos; the Service returns ranked likely causes, recommended tests, safety warnings, and next steps, and stores a history of your diagnoses.
3. Professional judgement and safety
The Service produces AI-generated output that may be incomplete or inaccurate. It is a decision-support tool for trained technicians — not a substitute for your own professional judgement, manufacturer documentation, local code, or licensed supervision. You are responsible for verifying every recommendation before acting on it, and for following all electrical, gas, refrigerant, and combustion safety practices. Do not rely on the Service for regulated professional advice without qualified oversight.
4. Your account and content
You must provide accurate information, keep it current, and keep your login credentials confidential. You are responsible for activity under your account, including activity by technicians you add to a company account. You keep ownership of the symptoms, notes, and photos you submit, and you grant us a limited licence to host and process that content solely to operate and improve the Service. You confirm you have the rights to any content you upload.
5. Acceptable use
You must not misuse the Service. In particular, you must not use it unlawfully; commit fraud or send spam; infringe anyone’s intellectual property; upload illegal, hateful, or deceptive content; attempt to jailbreak, probe, scrape, or interfere with the Service or its security; introduce malware; reverse engineer the Service; resell or redistribute it; or circumvent technical or plan limits.
We may remove or restrict content, filter or refuse outputs, and suspend accounts to enforce this section. Rights holders can raise a takedown request at support@techdiagnose.app; repeat infringement leads to account termination.
6. Intellectual property and licence
TechDiagnose retains ownership of the Service, its software, prompts, documentation, and branding. Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.
7. Availability
We work to keep the Service available, but we do not guarantee uninterrupted or error-free performance. Features may change, and maintenance or third-party outages may cause downtime.
8. Payment, subscriptions and refunds
Plans and prices are shown on our pricing page. Payment, billing, currency, tax, subscription renewal, cancellation, and refund mechanics are handled by our reseller under the Paddle Buyer Terms. Our own refund commitment is set out in our refund policy.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time. When access ends you can request an export of your diagnosis history within 30 days, after which we may delete it.
10. Warranties and liability
To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages, including lost profits, lost data, or goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing here excludes liability for fraud, death, or personal injury where the law does not allow it.
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
11. General
These terms are governed by the laws of the state in which TechDiagnose is established, and disputes will be heard by the courts of that jurisdiction. You may not assign this agreement without our consent; we may assign it in a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms and will post the revised version here with a new “last updated” date.
